Welcome to Arcfish Interactive Entertainment (“Arcfish,” “we,” “us,” or “our”). By accessing or using our website, services, applications, or games (collectively, the “Services”), you agree to comply with these Terms of Use (“Terms”). If you do not agree, you may not use our Services.
1. Eligibility
You must be at least 13 years old (or the minimum age required by your jurisdiction) to access or use our Services. If you are under the age of 18 (or the age of majority in your jurisdiction), you must have permission from a parent or legal guardian.
2. Account Registration
Some Services require creating an account (“Account”). You agree to provide accurate, complete, and current information during registration. You are responsible for maintaining the confidentiality of your account credentials. You are responsible for all activities that occur under your account. Arcfish reserves the right to suspend or terminate accounts that violate these Terms.
3. Community Guidelines
To foster a safe and enjoyable environment for everyone, all users agree to follow these guidelines:
- Respect others – No harassment, hate speech, threats, or discrimination.
- Play fairly – No cheating, exploiting bugs, or using unauthorized third-party tools.
- Keep it appropriate – No obscene, violent, or otherwise harmful content.
- Protect privacy – Do not share another user’s personal or confidential information.
Follow staff directions – Moderators and administrators may take action to enforce these guidelines. Violation may result in warnings, temporary suspension, permanent bans, or removal of content at Arcfish’s sole discretion.
4. User Conduct
You agree not to:
- Violate any applicable laws or regulations.
- Cheat, exploit, or manipulate game mechanics in unintended ways.
- Harass, abuse, or threaten other users.
- Impersonate Arcfish staff or other users.
- Distribute viruses, malware, or other harmful code.
- Engage in any activity that disrupts or interferes with the Services.
You also agree not to:
- Reverse engineer, decompile, or disassemble any part of the Services.
- Attempt to gain unauthorized access to any part of the Services or related systems.
- Use the Services for commercial purposes without prior written consent from Arcfish.
You may not:
- Upload or share content that is illegal, offensive, or infringes intellectual property rights.
- Use automated systems, bots, or scripts to interact with the Services unless expressly permitted.
5. Content Submission & Mod Policy
Ownership – You retain ownership of original content you create, including mods, skins, and community submissions (“User Content”).
License – By submitting or uploading User Content, you grant Arcfish a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to use, reproduce, modify, distribute, and display that content in connection with the Services.
Responsibility – You are solely responsible for ensuring your User Content does not infringe on third-party rights or violate laws. Content cannot contain any illegal, crude, or otherwise inappropriate material.
Moderation – Arcfish reserves the right to remove or disable access to User Content at any time for any reason.
Mods – Mods must comply with our Mod Policy, which may be updated from time to time. Mods that violate our guidelines may be removed, and accounts associated with such mods may be suspended or banned.
6. Refund Policy
All sales are final. Refunds will only be issued in the following cases:
- Defective or damaged physical merchandise.
- Digital unlocks, purchases, or downloads not functioning as intended due to Arcfish’s error.
Subscriptions:
- You may cancel a subscription at any time; service will continue until the end of the billing cycle.
- No partial refunds for unused subscription time.
In-game Purchases and Virtual Items
Purchases of virtual currency, items, or subscriptions are final and non-refundable unless required by law.
Virtual items have no real-world value and do not confer ownership outside the Services.
Arcfish may modify or remove virtual items or services at its discretion.
Arcfish reserves the right to adjust pricing and will notify users of changes in advance.
7. Privacy
Use of the Services is also governed by our Privacy Policy, which explains how we collect, use, and protect your information.
8. Termination
Arcfish may terminate or suspend your access to the Services at any time, for any reason, with or without notice. Upon termination, you must stop all use of the Services.
9. Intellectual Property
All content, software, trademarks, logos, and designs on the Services are owned by Arcfish or its licensors. You may not copy, modify, distribute, or create derivative works without express written permission. User-generated content may be used by Arcfish for promotional, commercial, or community purposes.
10. Disclaimers
The Services are provided “as-is” and “as-available.”
Arcfish makes no warranties regarding accuracy, reliability, or availability.
Use of the Services is at your own risk.
11. Limitation of Liability
To the maximum extent permitted by law, Arcfish is not liable for any indirect, incidental, or consequential damages arising from your use of the Services.
Arcfish’s total liability for any claim shall not exceed the amount you paid (if any) to access the Services in the prior six months.
12. Indemnification
You agree to indemnify, defend, and hold harmless Arcfish from any claims, damages, or expenses arising from your violation of these Terms.
13. Modifications to Terms
Arcfish may update these Terms at any time. Your continued use of the Services constitutes acceptance of the revised Terms.
14. Arbitration Agreement and Dispute Resolution
These Terms are governed by the laws of [Tarrant County, Texas].
Any disputes will be resolved through binding arbitration or in the courts of [Tarrant County, Texas], as applicable.
a. Binding Arbitration
You and Arcfish agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Services shall be resolved exclusively through final and binding arbitration, rather than in court, except that you may assert claims in small claims court if they qualify.
b. Arbitration Rules
The arbitration shall be conducted by [American Arbitration Association (AAA)] under its Consumer Arbitration Rules, or by another mutually agreed arbitration provider. The arbitrator shall have the authority to award any relief available in court, including injunctive relief.
c. Class Action Waiver
You and Arcfish agree that all claims must be brought in your individual capacity, and not as a plaintiff or class member in any purported class, collective, or representative proceeding. The arbitrator may not consolidate more than one person’s claims or otherwise preside over any form of a class or representative proceeding.
d. Jury Trial Waiver
To the extent allowed by law, you and Arcfish each waive any right to a trial by jury.
e. Opt-Out Option
You may opt out of this arbitration agreement by sending written notice to Arcfish within 30 days of accepting these Terms. Your opt-out notice must include your name, account ID (if applicable), and a clear statement of your intent to opt out of arbitration.
f. Governing Law
This Arbitration Agreement shall be governed by the Federal Arbitration Act (“FAA”) and applicable federal arbitration law.
